Governor may proclaim a state of extreme peril and deploy the national guard or militia in response to enemy attacks, natural disasters, riots, epidemics, violent insurrection, or similar conditions threatening safety of persons and property.

Governor's emergency powers are limited to issuing written rules, regulations, and orders necessary to support national guard/militia operations and protect life and property, and all rules must be narrowly tailored and not restrict the right of Idahoans to work or contribute to the economy.

State of extreme peril may not exceed 60 days unless extended solely to receive federal funding and benefits, and the legislature may terminate the state of extreme peril by concurrent resolution at any time.

Governor may not alter, adjust, or suspend any provision of the Idaho Code during a state of extreme peril, and may not impose additional restrictions on lawful firearms possession, transfer, sale, or use, or limit constitutional rights to peaceable assembly and free exercise of religion.

Governor's emergency rules are subject to rejection by the legislature through concurrent resolution, and the bill includes severability provisions.
