Public entities in Idaho may not enter into contracts for services, supplies, information technology, or construction with companies that boycott Israel or territories under its control unless the contract includes written certification of non-boycott compliance.

Exemptions apply to contracts with a total potential value of less than $100,000 or with contractors having fewer than 10 employees.

"Boycott Israel" is defined as refusals to deal, termination of business activities, or other actions intended to discriminate against or inflict economic harm on Israel, its territories, or entities doing business there, including company statements confirming participation in such boycotts as conclusive evidence.

Contracts executed on or after July 1, 2021, must comply with these provisions; contracting authorities have 90 days to obtain required certifications after discovery of non-compliance, after which violating contracts become void as against public policy.

The Department of Administration is authorized to promulgate rules implementing this section consistent with its provisions and without creating exceptions to it.
