Amends Section 40-109 of Idaho Code to revise the definition of "highways" to explicitly include warranted public transportation, bicycle, and pedestrian facilities.

Changes language from "shall include" to "may include" regarding what structures and works can be considered part of highways.

Clarifies that highways encompass roads, streets, alleys, bridges, culverts, drains, ditches, waterways, embankments, retaining walls, tunnels, grade separation structures, and roadside improvements.

Maintains existing provisions that roads recorded as highways by board of commissioners order or used as highways for five years with public maintenance constitute highways.
