Board of trustees may expel or deny enrollment to students who possess deadly or dangerous weapons or firearms on school property, or meet other grounds for expulsion including habitual truancy, incorrigibility, or disruptive conduct.

Students found to have carried a weapon or possessed a firearm on school property must be expelled for not less than one (1) year or twelve (12) calendar months, unless the board determines on a case-by-case basis that reasonable conditions apply and the student's presence is not detrimental to health and safety.

Discipline of students with disabilities must comply with federal law Part B of the Individuals with Disabilities Education Act and Section 504 of the Rehabilitation Act.

Board must provide written notice to parents or guardians stating grounds for expulsion or denial of enrollment, and must grant a full and fair hearing where the student can be represented by counsel, present witnesses and evidence, and cross-examine witnesses.

Defines "possess," "deadly or dangerous weapon," and "firearm" by reference to Section 18-3302D, Idaho Code, and requires school board representatives to report expelled students and incidents to appropriate law enforcement agencies.
