Amends the definition of burglary in Idaho Code Section 18-1401 to exclude buildings specifically defined in Section 18-1401A (commercial establishments).

Redefines commercial burglary as entering a commercial retailer during business hours with intent to commit theft where the theft amount is under $300.

First-time commercial burglary conviction results in misdemeanor charges with up to 6 months jail, $1,000 fine, or both.

Second commercial burglary conviction within 5 years results in misdemeanor charges with up to 1 year jail, $2,000 fine, or both.

Third or subsequent commercial burglary conviction within 5 years is charged as a felony.
