Creates a separate Disaster Emergency Account in the state treasury, administered by the governor or designee, to pay obligations and expenses incurred during a declared state of disaster emergency.

Establishes a three-tier funding hierarchy: first use available disaster emergency account funds, then transfer from general account fund if needed, and finally transfer from any eligible state accounts if both previous sources are inadequate.

Limits emergency fund transfers to amounts the governor judges will not prevent support of current fiscal year appropriations for affected accounts.

Caps total revenues available from subsection (2)(b) and (c) at one percent (1%) of the annual general account fund appropriation for any fiscal year.

Allows restitution received from nonstate sources for disaster response costs to reimburse accounts from which funds were previously drawn and declares all provisions of the section to be severable.
