S1139 Summary

• Adds new definitions including "medically unknown symptoms" (symptoms suggestive of infectious or communicable disease not revealing structural pathology on initial examination) and "restricted access" (limited or disallowed access to cordoned areas or places with posted signs).

• Revises "isolation" definition to apply to persons diagnosed with infectious or communicable disease, presenting medically unknown symptoms, or contaminated from chemical, nuclear, or biological agents while they remain infectious, symptomatic, or contaminated.

• Revises "quarantine" definition to apply to persons exposed to infectious or communicable disease, persons displaying medically unknown symptoms, or persons exposed to chemical, nuclear, or biological contamination for a reasonable period to determine if exposure results in illness.

• Authorizes the director to issue orders of isolation, quarantine, or restricted access without Idaho administrative procedure act requirements; establishes that judicial review is de novo with hearings held within three business days and using preponderance of clear and convincing evidence standard.

• Establishes that violations of isolation, quarantine, or restricted access orders constitute misdemeanors and requires the director to develop safeguards for nonpublic personal information and authenticate requests under the 2007 Hague Convention on child support recovery.
