Proposes a new Section 30 to Article III of the Idaho Constitution prohibiting production, manufacture, transportation, sale, delivery, dispensing, distribution, possession, or use of Schedule I and Schedule II controlled substances in Idaho.

Permits psychoactive drugs only if they are FDA-approved prescription or biological therapeutic products prescribed and used as directed by a licensed prescriber, or part of an FDA clinical investigation, or provided under the right to try act.

Allows possession of psychoactive drugs when held as evidence by law enforcement, testing laboratories, court personnel, or prosecutors, or when held by registered testing laboratories for specimen testing purposes.

Defines "psychoactive drug" as any Schedule I or Schedule II controlled substance identified in Idaho Code sections 37-2701(t), 37-2705, and 37-2707 as they existed on July 1, 2021, including any substances added through subsequent amendments.

Directs the Legislative Council to prepare required statements and the Secretary of State to publish the proposed constitutional amendment and supporting arguments for voter consideration at the next general election.
