Adds Section 46-114 to Idaho Code establishing the "Defend the Guard Act" to restrict deployment of Idaho National Guard members in active duty combat.

Prohibits release of Idaho National Guard from state into active duty combat unless Congress passes an official declaration of war or takes official action under Article I, Section 8, Clause 15 of the U.S. Constitution to explicitly call forth the Guard to execute federal laws, repel invasion, or suppress insurrection.

Defines "active duty combat" as participation in armed conflict, performance of hazardous service relating to armed conflict in a foreign state, or performance of duty through an instrumentality of war.

Requires the Governor to take all necessary actions to comply with these restrictions while preserving authority to consent to deployment for Title 32 U.S.C. defense support for civil authority missions within the United States and U.S. territories.

Declares an emergency and makes the act effective immediately upon passage and approval.
