First-trimester abortions remain lawful when performed by a physician in a hospital, office, or clinic after consultation with the patient and physician determination that abortion is appropriate, considering medical and non-medical factors including rape, incest, age, and the patient's physical and psychological well-being.

Second-trimester abortions shall only be lawful if performed in a hospital and determined by the attending physician to be in the best medical interest of the pregnant woman.

Third-trimester abortions shall only be lawful if performed in a hospital with corroboration by a consulting physician, and only when necessary to preserve the life of the pregnant woman or when the fetus is unable to survive outside the womb.

Third-trimester abortions for preservation of the pregnant patient's life must be performed in a manner consistent with preservation of any reasonable potential for fetal survival.

Nothing in this section makes legal any abortion otherwise prohibited under other Idaho law, including section 18-622.

The act becomes effective thirty days following the Governor's signature.
