Amends Idaho Code Section 55-603 to allow easements in gross of a commercial character to be transferred, assigned, or conveyed according to the express language of the instrument.

Defines "easement in gross of a commercial character" as a personal interest in or right to use another's land for specific commercial purposes.

Establishes four categories of commercial easements: transmission or distribution of water, sewer, natural gas, or petroleum products; provision of telephone or data service; transmission, distribution, or transformation of electricity; and commercial agricultural uses including grazing, farming, and timber harvesting.

Preserves existing law that transfers of real property automatically pass all attached easements and create easements for uses obviously and permanently established by the prior owner.

Declared an emergency measure effective July 1, 2022.
