House Bill 601 Summary

• Amends Idaho Code Section 39-3316 to establish in-person visitation rights for residents of residential care or assisted living facilities, subject to the resident's right to deny or withdraw consent at any time.

• Permits immediate in-person access by immediate family or other relatives, and allows reasonable access by others visiting with the resident's consent, subject to reasonable restrictions.

• Authorizes facilities to impose certain health and safety precautions on visitors including health screenings, infection control procedures, personal protective equipment requirements, and occupancy limitations.

• Prohibits facilities from precluding in-person access based on a visitor's vaccination status, notwithstanding any other provision of law.

• Declares an emergency and makes the act effective July 1, 2022.
