Requires substitute teachers to undergo a criminal history check before working as a substitute teacher in any district, with checks required every two (2) years to remain on the statewide substitute teacher list.

Substitute teachers must test negative for drugs in accordance with Idaho Code chapter 17, title 72, with results valid for thirty (30) days across districts.

A substitute teacher who fails a drug test is prohibited from employment as a substitute for one (1) calendar year in any Idaho district; three (3) failures within three (3) years results in a five (5) year ban from any district employment.

A substitute teacher who has passed a drug test in one district is not required to pass another drug test within thirty (30) days when working in another district.

Act takes effect immediately upon passage and approval as an emergency measure.
