House Bill No. 671 Summary

• Recall elections for school district trustees must be held on an election date authorized under Idaho Code section 34-106(9)

• When a trustee is recalled or resigns following a prospective recall petition, any resulting vacancy shall be filled by election on the next available authorized election date that is at least 85 days after the county clerk orders the election

• If the recall election will be held within 120 days of the clerk's order, the seat remains vacant until the election; if held more than 120 days later, the board may appoint a temporary trustee to serve until the election

• If multiple trustee recalls eliminate the board's quorum, county commissioners shall appoint only the minimum number of temporary trustees necessary to restore a quorum until the next election date

• The act is declared an emergency and takes effect upon passage and approval
