House Bill No. 676 Summary

• Amends Section 18-3302 to add a technical correction changing "Over is" to "Is" in the exception allowing persons 18 years or older to carry concealed weapons outside city limits without a license.

• Revises Section 18-3302J to expand the state's preemption of firearms regulation by prohibiting counties, cities, and political subdivisions from adopting taxes, laws, rules, regulations, ordinances, or lease agreements that regulate, discourage, or limit the sale, acquisition, transfer, ownership, possession, transportation, carrying, or storage of firearms and ammunition.

• Establishes civil enforcement provisions allowing any person or public entity, governmental entity, person, or membership organization to sue for declaratory relief, injunctive relief, and damages for violations of the preemption requirements.

• Provides that prevailing plaintiffs in civil suits shall be awarded reasonable attorney's fees and costs, including contingency fees and actual damages incurred, with interest accruing at the legal rate from the date suit was filed.

• Becomes effective July 1, 2022, with an emergency declaration.
