House Bill 727 Summary

• Establishes a procedure allowing Idaho legislators to challenge federal executive orders, agency orders, rules, policy directives, and regulations that exceed enumerated federal powers or conflict with Idaho's constitution.

• Any Idaho House or Senate member may file a complaint with the federalism committee chair, House Speaker, and Senate President Pro Tempore, which must be surveyed within 15 days and scheduled for public hearing within 30 days if deemed meritorious.

• Federal actions begun after January 1, 2022 are prohibited from enforcement by state agencies or political subdivisions during the hearing process; federal actions begun before that date remain in effect throughout hearings.

• If the committee finds a federal action exceeds federal authority or violates Idaho's constitution, it prepares a report and recommends legislation to the full legislature declaring the action null and void within Idaho.

• Once legislation proclaiming a federal action invalid is enacted, no state agency or political subdivision may enforce it; the enforcement prohibition expires if no determination is made by the end of the legislative session following the hearing convening.
