Foreign nationals are prohibited from making contributions, independent expenditures, or electioneering communications to any candidate, political committee, or measure in Idaho.

"Foreign national" is defined as individuals not lawfully admitted for permanent residence, foreign governments or subdivisions, foreign political parties, or entities organized under foreign laws or with principal places of business in foreign countries.

Corporations organized under United States laws that are in a parent-subsidiary relationship with a foreign corporation are excluded from the definition of "foreign national."

Knowing and willful violations exceeding $1,000 in a consecutive 12-month period, or a second violation within 10 years, are prosecuted as felonies; other violations follow the penalties provided in section 67-6625(2) through (5) of Idaho Code.

The act becomes effective July 1, 2022, and is declared an emergency measure.
