House Bill 814 Summary

• Amends Idaho Code Section 18-3316 to clarify that a person "stands convicted" of a felony when a guilty plea or verdict is entered, regardless of pending sentencing, appeals, or other post-conviction proceedings.

• Adds exception allowing persons whose civil right to bear arms has been restored under Idaho law or by another jurisdiction to legally possess firearms, notwithstanding prior felony convictions.

• Revises Idaho Code Section 19-2604 to allow courts to amend felony convictions to misdemeanors for defendants who successfully complete authorized treatment court programs or meet other specified conditions.

• Expands eligibility for discharge and amendment of judgment relief by removing restrictions on certain defendants and clarifying requirements for drug court and mental health court program graduates.

• Declares Section 2 (discharge and amendment provisions) an emergency measure effective immediately upon passage and approval.
