• Amends Section 33-1002, Idaho Code to include state support for discretionary spending by school districts as a deductible item from total state educational support funds.

• Creates new Section 33-1029, Idaho Code establishing a discretionary spending program that distributes state funds to school districts on a per-student basis according to a formula in the appropriations bill.

• Allows school district boards of trustees to use discretionary spending funds at their discretion, except that districts with active supplemental levies must use 75% of funds to reduce the levy.

• Imposes a two-year ineligibility penalty on school districts that fail to comply with the 75% levy reduction requirement.

• Effective July 1, 2022, declared as an emergency measure.
