Senate Bill 1336 Summary

• Establishes Chapter 97 in Title 39, Idaho Code to guarantee residents' rights to visitation by essential caregivers designated by the resident while receiving health care services or assistance in a facility.

• Defines "facility" to include hospitals, nursing facilities, skilled nursing centers, residential treatment centers, rehabilitation facilities, certified family homes, group homes, and assisted living facilities.

• Permits facilities to impose reasonable restrictions on essential caregiver visits only when necessary to prevent disruption of care services and provided the restrictions do not interfere with the resident's general right to visitation.

• Requires facilities to notify potential residents of their right to designate an essential caregiver prior to admission and provide each resident an opportunity to designate one.

• Becomes effective July 1, 2022, with emergency declaration.
