Licensed outfitters and guides are not liable for participant damages or injuries unless caused by negligent, reckless, or intentional conduct of the outfitter or guide.

Liability limitations apply only to appropriately licensed outfitters and guides acting within the course of employment; standard negligence and comparative negligence laws of Idaho apply otherwise.

Outfitters and guides have no duty to eliminate, alter, control, or lessen risks inherent in recreational activities, and participants assume all such inherent risks.

Written liability waivers signed by participants to prospectively waive negligence claims against licensed outfitters and guides are enforceable to the same degree as similar waivers for other activities.

The act becomes effective July 1, 2022, with an emergency declaration.
