House Bill 167 Summary

• Creates new crime of critical infrastructure trespass for knowingly entering or remaining at critical infrastructure facilities without permission or after notice to depart.

• First offense is a misdemeanor punishable by up to 6 months jail, $1,000 fine, or both; second offense within 5 years is a felony punishable by up to 10 years imprisonment, $10,000 fine, or both.

• Exempts property owners or legal occupants conducting authorized activities, persons engaged in lawful behavior permitted by legal or regulatory processes, and persons participating in constitutionally protected public demonstrations.

• Imposes civil and criminal penalties up to $100,000 on individuals or organizations that aid, abet, solicit, compensate, hire, or conspire with persons committing the offense.

• Authorizes Idaho Attorney General to prosecute violations if local prosecuting attorneys refuse to do so; effective July 1, 2023.
