Adds new definition of "congestion mitigation" as transportation road projects designed to reduce traffic congestion, travel delays, engine idle time, and unproductive fuel consumption.

Specifies that congestion mitigation includes improving vehicle traffic flow and travel times through expanding vehicle travel lanes, improving intersection efficiency, adding turning lanes, improving transportation management systems and signal operations, and implementing intelligent transportation system strategies.

Renumbers existing definitions in Idaho Code Section 40-104 to accommodate the new "congestion mitigation" definition, shifting subsequent definitions from (5)-(7) to (6)-(8) and (8)-(10).

Makes technical corrections to Section 40-104, including changing "which" to "that" in the definition of "city system."

Declares an emergency and makes the act effective on July 1, 2023.
