HB 206 Summary

• Replaces automatic annual rule expiration with a periodic review system requiring all rule chapters in effect on July 1, 2026, to be reviewed by the legislature on a staggered schedule between July 1, 2026, and June 30, 2034, and every eight years thereafter.

• Creates new legislative review procedures allowing standing committees to review temporary, pending, and final rules for consistency with legislative intent, and authorizing concurrent resolutions to approve or reject rules in whole or in part.

• Distinguishes between "pending fee rules" and "pending non-fee rules," with fee rules requiring affirmative legislative approval by concurrent resolution to become final and effective.

• Requires agencies to allow oral presentations through video conference or telephone, and beginning July 1, 2026, to post recordings of oral presentations and public hearings on rules for at least three years.

• Takes effect July 1, 2023, as an emergency measure, and removes prior provisions regarding automatic rule expiration under former section 67-5292.
