Public entities in Idaho are prohibited from entering into contracts with companies for services, supplies, information technology, or construction unless the contract includes written certification that the company is not owned or operated by the government of China.

"Government of China" is defined as the People's Republic of China led by the Chinese communist party, and "company" includes for-profit and not-for-profit organizations, corporations, partnerships, and all wholly owned subsidiaries, majority-owned subsidiaries, parent companies, or affiliates.

The prohibition applies to contracts executed on and after July 1, 2023; contracting authorities have 90 days to obtain required certification upon discovering noncompliance, after which violating contracts become void as against public policy.

Contracts executed prior to July 1, 2023 that violate the provisions will not be renewed.

The Department of Administration is authorized to promulgate rules to implement this section consistent with its provisions and without creating exceptions to it.
