H.B. 295 - Second Amendment Financial Privacy Act

• Prohibits payment networks from assigning or requiring firearms codes that distinguish firearms retailers from other merchants in Idaho.

• Prevents state and local government entities from creating or maintaining registries of privately owned firearms or firearm owners.

• Prohibits payment networks from discriminating against firearms retailers by declining transactions, limiting business, charging higher fees, or taking action based on firearms code assignment.

• Authorizes the Attorney General to investigate violations and provides for injunctions with civil penalties up to $10,000 per violation; allows affected firearms retailers or customers to petition for investigation or file suit if AG does not act within 90 days.

• Effective July 1, 2023, with exemptions for records kept during criminal investigations and for federally required disclosures made in good faith.
