No in-person student instruction shall occur on election days taking place in May and November each year, and on any day a school district holds an election pursuant to Idaho Code section 34-106(7).

School boards must determine what instruction and activities occur on election days, which shall not require or encourage students to be present in school buildings.

In-person instruction may occur if a joint resolution between the county clerk and school district confirms that student-occupied buildings will not be designated as polling places.

For purposes of this requirement, "instruction" includes virtual instruction and "activities" includes professional development, personnel training, teacher in-service, and parent-teacher conferences.

The act takes effect on July 1, 2024.
