House Bill 338 Summary

• Prohibits Idaho political subdivisions from enacting ordinances or policies that limit or prohibit law enforcement officers and local officials from communicating with federal immigration officers about a person's immigration status.

• Prohibits political subdivisions from enacting policies that limit or prevent state or local corrections officials from complying with federal immigration detainer requests, requiring subjects to be held for 72 hours from their intended release date.

• Allows residents of a political subdivision to bring civil actions in district court to enjoin ordinances or policies that violate these provisions, with court-ordered damages between $2,500 and $10,000 per day the violation remains in effect.

• Directs the state tax commission to withhold sales and use tax revenue distributions to any political subdivision until judgments are paid in full, with proceeds distributed to the local county sheriff's office if the state brings the action or to the resident plaintiff if a resident brings the action.

• Allows victims of murder, rape, or felonies committed by aliens to bring civil actions against political subdivisions that intentionally violated detainer compliance requirements.
