• Amends Idaho Code Section 18-604 to revise the definition of "abortion" and clarifies that intrauterine devices, birth control pills, removal of dead unborn children, and treatment of non-pregnant women are not considered abortions.

• Establishes that abortions performed to prevent the death of a pregnant woman or to treat a life-threatening physical condition, or abortions during the first trimester in cases of reported rape or incest, are not criminal abortions.

• Requires women reporting rape or incest to provide a copy of the law enforcement or child protective services report to the physician performing the abortion, with reports remaining confidential medical records.

• Provides that persons making rape or incest reports are entitled to receive a copy of their report within 72 hours, with possible redactions to avoid interference with investigations.

• Specifies that accidental deaths or unintentional injuries to unborn children resulting from medical treatment are not violations, and pregnant women cannot be criminally convicted for abortions performed on them.

• Effective date: July 1, 2023.
