House Bill 370 - Idaho Medical Cannabis Act

• Establishes the "Idaho Medical Cannabis Act" authorizing possession, distribution, and use of medical cannabis for individuals diagnosed with 15 specific substantial health conditions (including cancer, epilepsy, PTSD, ALS, and others) effective January 1, 2026.

• Creates a medical cannabis card system administered by the Department of Health and Welfare, with cardholders limited to 1,000 milligrams of medical cannabis per month through licensed pharmacists.

• Authorizes the State Board of Pharmacy to issue up to 4 medical cannabis production licenses per year to qualified applicants who grow, process, and distribute medical cannabis to licensed dispensaries.

• Removes marijuana and THC from Schedule I controlled substances and moves them to Schedule II, while maintaining criminal penalties for non-compliant possession and establishing exceptions for authorized medical cannabis users.

• Provides liability protections for practitioners and pharmacists recommending or dispensing medical cannabis, and prohibits discrimination against medical cannabis cardholders in employment, housing, organ transplants, and custody matters.
