Senate Bill 1006 Summary

• Adds Chapter 60 to Title 19, Idaho Code, prohibiting governmental entities from adopting or enforcing policies that discourage immigration law enforcement by peace officers, corrections officers, booking clerks, magistrates, or prosecutors.

• Requires governmental entities to allow employees to inquire about immigration status, communicate with federal immigration agencies, maintain immigration records, and permit federal immigration officers to conduct enforcement activities at jails.

• Authorizes the Idaho Attorney General to receive complaints about violations, conduct investigations, and file lawsuits seeking injunctive relief to compel compliance within 90 days of notification.

• Imposes penalties on violating governmental entities by denying them sales tax distribution funds for the fiscal year following a final judicial determination that the entity intentionally prohibited or discouraged immigration law enforcement.

• Becomes effective July 1, 2023, with emergency declaration.
