Senate Bill 1042 Summary

• Exempts public charter schools with 100% at-risk student enrollment (as defined by section 33-1001(3)) from the requirement to demonstrate strong academic results on the Idaho standards achievement test to qualify for the Public Charter School Facilities Program.

• Revises the limitation on bond issuance under the facilities program to use the percentage of Idaho public school students attending public charter schools as of July 15 of the prior calendar year (rather than the current date) multiplied by two and then multiplied by the par amount of bonds guaranteed under the Idaho School Bond Guaranty Act as of June 30 of the prior calendar year.

• Clarifies that bonds issued under the public charter school facilities program shall not be subordinate to any other obligations used to finance the same project.

• Effective date: July 1, 2023, with an emergency declaration.
