Adds exemption from postelection audits for any precinct reporting election results that meets the free recount threshold requirement in section 34-2309, Idaho Code.

Secretary of state shall identify and order postelection audits of paper ballots after county canvasses complete, posting selected elections, counties, and precincts to the secretary of state website.

Precincts selected for audit shall not exceed 5% of county precincts or one precinct (whichever is greater), selected by lot without computer use at an open public meeting.

Secretary of state may select days, batches, legislative districts, or tabulation machines of early or absentee ballots as alternative audit method for counties that organize storage by these categories rather than by precinct.

Effective date is July 1, 2023, with emergency clause declared.
