Senate Bill 1059 Summary

• Creates new Chapter 60, Title 19, Idaho Code to establish an address confidentiality program allowing justices, judges, and magistrate judges to protect their residential street addresses and telephone numbers from public disclosure.

• Requires judicial officers to submit an application to the Idaho Supreme Court containing sworn statements from their employing entity and themselves, an alternative mailing address (chambers address), and designation of their employer as agent for service of process.

• Protects confidential information for a 4-year period, renewable upon resubmission of application and fee; public agencies may charge fees not exceeding actual compliance costs.

• Allows disclosure of protected addresses only upon court order, law enforcement request, financial institution or title company business request, or with written permission from the judicial officer.

• Exempts public agencies and employees from liability under Idaho tort claims act for release of confidential information under this chapter and extends existing address confidentiality protections to declarations of candidacy and public records exemptions.

• Effective July 1, 2023, declared as emergency legislation.
