Establishes legislative intent that there are only two sexes (male and female), that sex is biologically determined and observable at or before birth, and that sex cannot be determined by self-identification or stipulation.

Amends Idaho Code Section 73-114 to define "sex" as an individual's biological sex (either male or female), and defines "male" and "female" based on reproductive system characteristics; specifies that "gender" when referring to males and females is a synonym for "sex" and not a synonym for gender identity or expression.

Amends Section 18-1506C to prohibit medical providers from performing surgeries, mastectomies, puberty-blocking medications, or hormone treatments on children for the purpose of altering appearance or affirming perception of sex inconsistent with biological sex; violations are felonies punishable by up to 10 years imprisonment.

Amends Section 33-6702 (formerly 33-6602) to define "sex" for school purposes as immutable biological and physiological characteristics based on chromosomes and reproductive anatomy genetically determined at conception.

Amends Section 39-245A to require Idaho birth certificates to document sex based on immutable biological characteristics; allows amendments within one year by notarized affidavit or in court after one year only on basis of fraud, duress, or material mistake of fact.

Becomes effective July 1, 2024.
