House Bill 427 Summary

• Amends Idaho Code sections 19-1116, 19-1117, 19-1120, 19-1122, and 19-1123 to revise special inquiry judge proceedings and expand the role of the Attorney General.

• Authorizes the Attorney General of Idaho to petition for appointment of a special inquiry judge to investigate suspected crime or corruption, in addition to county prosecuting attorneys.

• Grants the Attorney General equal authority with prosecuting attorneys to issue subpoenas, request court orders regarding subpoenas, and call witnesses in special inquiry judge proceedings.

• Clarifies that prosecuting attorneys or the Attorney General (depending on who filed the petition) shall have access to all special inquiry judge evidence and may introduce it before grand juries or judicial proceedings.

• Takes effect July 1, 2024, with an emergency declaration.
