Establishes death penalty as potential punishment for lewd conduct with a minor child under 12 years of age, subject to statutory aggravating circumstances and prosecutorial notice requirements.

Increases maximum penalty for lewd conduct with a minor aged 12 to 15 from life imprisonment to a fixed term (previously life with unspecified term).

Makes lewd conduct with a minor child under 12 a capital offense eligible for death penalty sentencing procedures, including special sentencing proceedings and jury determinations of aggravating circumstances.

Adds "lewd conduct with a minor child" to Idaho Code Section 19-2515 capital case provisions, requiring statutory aggravating circumstance findings before death penalty can be imposed.

Becomes effective July 1, 2024, with emergency declaration.
