House Bill 517 Summary

• Creates a civil cause of action against governmental entities and employees for deprivation of religious liberty (Idaho Constitution Article I, Section 4) or freedom of speech (Article I, Section 9).

• Allows governmental entities to substantially burden a person's exercise of religion only if they demonstrate the burden is essential to further a compelling governmental interest and is the least restrictive means available.

• Requires governmental entities to provide defense and indemnification for employees sued within the course and scope of employment, with liability limited to each defendant's pro rata share of damages.

• Establishes a two-year statute of limitations for claims, with six-year limit for minors or cases involving fraud or concealment.

• Caps noneconomic damages at $20,000 per claimant and allows courts discretion to award reasonable attorney's fees to the prevailing party.

• Effective July 1, 2024.
