House Bill 519 Summary

• Creates two new crimes: impeding critical infrastructure (blocking operations or damaging facilities) and critical infrastructure trespass (entering facilities without permission).

• Impeding critical infrastructure is a misdemeanor for damage/loss under $10,000 (up to 6 months jail and $10,000 fine) or felony for $10,000+ damage (up to 2 years prison and $100,000 fine).

• Critical infrastructure trespass is a misdemeanor on first offense (up to 6 months jail and $1,000 fine) and felony on second offense within 5 years (up to 10 years prison and $20,000 fine).

• Defines 21 categories of critical infrastructure facilities including refineries, power plants, water treatment facilities, pipelines, telecommunications, airports, military facilities, and mining operations.

• Includes exceptions for property owners, legal/regulatory activities, and constitutionally protected public demonstrations and free speech on public land; allows Idaho Attorney General to prosecute if local prosecutors refuse.
