Adds new section 16-1648 to Idaho Code prohibiting state government from taking discriminatory action against persons providing adoption or foster care services based on sincerely held religious beliefs.

Defines "discriminatory action" to include altering tax treatment, denying state grants or contracts, withholding licenses or certifications, and taking adverse employment action against individuals or organizations.

Allows persons to assert violations as claims or defenses in judicial or administrative proceedings without exhausting administrative remedies, with a 2-year statute of limitations from the date of the discriminatory action.

Permits successful claimants to recover declaratory relief, injunctive relief, compensatory damages, and reasonable attorney's fees and costs.

Waives and abolishes sovereign, governmental, and qualified immunities for state government liability under this section, allowing persons to sue the state for damages except against state courts.

Effective July 1, 2024.
