Amends Section 59-1606, Idaho Code, regarding vacation time for nonclassified state officers and employees in the executive and legislative departments.

Employees previously employed by a county office of public defender or joint office of public defender and hired by the office of the state public defender prior to January 1, 2025, shall have all credited service earned for the public employee retirement system counted as credited state service for vacation purposes.

Allows eligible employees, at their discretion, to secure and credit up to 40 hours of unused paid time off to be utilized as vacation time.

Requires the officer or employee's prior employing county to request and deposit funds corresponding to the secured and credited vacation hours into the state public defense fund established by Section 57-827, Idaho Code.

Declares an emergency, making the act effective upon passage and approval.
