Creates new crime of organized retail theft under Idaho Code 18-2403A, applicable when a person acting with another commits theft of merchandise from a mercantile establishment meeting one of three thresholds: aggregate theft exceeding $1,500 within 90 days, theft exceeding $750 within 90 days with intent to resell, or two or more thefts within 30 days totaling 10 or more items.

Classifies organized retail theft as a felony punishable by up to 15 years imprisonment, a fine of $20,000, or both.

Doubles maximum penalties (30 years imprisonment, $40,000 fine) when the offender is a manager of the organized retail theft, defined as someone who recruits, organizes, supervises, finances, or directs others to commit the offense.

Defines "merchandise" as personal property displayed, held, or offered for sale by a merchant, and "mercantile establishment" as any place where merchandise is displayed, held, or offered for sale at retail or wholesale.

Effective July 1, 2024.
