First-time violation of passing a stopped school bus is an infraction punishable by a fine of $300, increased from the previous tiered structure.

Second offense or subsequent offense within five years is a misdemeanor punishable by a fine of $600-$1,000, or imprisonment in county jail not exceeding six months, or both.

Fines in excess of $100 are deposited into a newly created school bus camera fund in the state treasury, to be overseen by the state department of education.

School bus camera fund moneys may be appropriated only for school bus stop arm software, equipment, and training to enforce the school bus passing law; if no program is established by July 1, 2024, funds are distributed per general statute.

Effective date is July 1, 2024, and the bill is declared an emergency measure.
