House Bill 645 Summary

• Vacancy shall be declared within 30 days when a trustee dies, resigns, removes themselves from their zone of residence, is no longer a resident or school district elector, refuses to serve, or fails to attend four consecutive regular meetings without acceptable excuse.

• Trustees subject to special recall elections are prohibited from participating in actions that would alter the board structure or create new contractual or financial obligations for the school district between the recall election and proclamation of results.

• Board of trustees must appoint a qualified person to fill vacancies within 90 days; if unable to appoint from the vacated zone within 90 days, the board may appoint an at-large candidate from the school district; after 120 days, appointments transfer to the board of county commissioners.

• Quorum for board business requires a majority of members; when one or more vacancies exist pursuant to section 33-504, business may proceed if a majority of the remaining members are present.

• Act becomes effective July 1, 2024, and is declared an emergency measure.
