Governor appoints the executive officer of the state board of education with advice and consent of the senate, serving at the governor's pleasure with salary fixed by the governor.

Executive officer and state board president must submit an annual report to the legislature by January 15 detailing uses and impact of the school modernization facilities fund.

School districts must submit a 10-year facilities plan and attest they will not convert from five-day to four-day school weeks (or meet minimum instructional requirements if already on four-day week) to receive school modernization fund distributions.

School districts must attest compliance with dignity and non-discrimination requirements and confirm they do not require job applicants to sign written diversity statements to receive fund distributions.

Misused funds must be returned to the state general fund and redistributed to rural schools; funds cannot be used for facilities with a primary athletic purpose, and a model school facility council must adopt recommendations by July 1, 2026.

Effective date is July 1, 2024, declared as an emergency.
