Senate Bill 1222 - Children's Device Protection Act

• Requires all tablets and smartphones manufactured on or after January 1, 2025, activated in Idaho to include an internet filter that blocks obscene material, with the filter automatically enabled for minor users and protected by a password.

• Imposes civil and criminal liability on device manufacturers who fail to enable compliant filters upon activation in the state if a minor accesses obscene material, unless the manufacturer makes good faith efforts to provide a generally accepted and commercially reasonable filter.

• Authorizes the Attorney General to bring enforcement actions seeking civil penalties up to $5,000 per violation (maximum $50,000 per case), injunctions, and recovery of costs and attorney's fees.

• Allows parents or legal guardians to sue manufacturers for damages of up to $50,000 per violation or punitive damages if willful, and permits class action lawsuits for knowing and willful violations.

• Makes it a criminal offense for any person except parents or guardians to disable a minor's device filter, punishable by fines up to $5,000 for first offense and $50,000 for second offense, with possible imprisonment up to one year for repeat offenses.
