Amends Idaho Code Section 58-1312 to define "has not been modified" as meaning the overall footprint of an encroachment on the lake bed has not changed in dimension, orientation, height, or location.

Permits persons seeking permits for navigational or nonnavigational encroachments constructed prior to January 1, 1975 to receive an encroachment permit without paying application and publication fees if they provide substantive documentation of the encroachment's age and that it has not been modified since 1974.

Requires persons seeking permits for encroachments constructed, replaced, or modified on or after January 1, 1975 to submit a permit application and follow the standard permitting process for new encroachments.

Specifies that acceptable substantive documentation includes dated aerial photographs, tax records, or other historical information deemed reliable by the board.

Takes effect July 1, 2024, under an declared emergency.
