Amends Idaho Code Section 58-1312 to define "has not been modified" for existing encroachments as meaning the overall footprint on the lake bed has not been expanded in dimension or height or changed in orientation or location.

Allows persons seeking permits for navigational or nonnavigational encroachments constructed before January 1, 1975 to receive a permit without paying application and publication fees if they provide substantive documentation of age and no modifications since 1974.

Specifies that acceptable documentation includes dated aerial photographs, tax records, or other historical information deemed reliable by the board.

Requires encroachments constructed, replaced, or modified on or after January 1, 1975 to follow the standard permitting process required for new encroachments.

Takes effect July 1, 2024 as an emergency measure.
