Repeals existing Section 58-120 and replaces it with a new provision allowing the Department of Lands to hire an independent general counsel subject to state land board approval, independent of the Attorney General's office.

Permits the Department of Lands' general counsel to hire additional attorneys or contract with the Attorney General's office as necessary, and does not prohibit separate counsel from being hired outside the general counsel position.

Amends Section 67-1406 to explicitly add the Department of Lands to the list of state entities authorized to employ private counsel to advise and represent them in Idaho state courts, consistent with self-governing agencies and colleges/universities.

Effective date is July 1, 2024, declared as an emergency measure.
