Senate Bill 1327 Summary

• Creates automatic shielding of unlawful detainer records from public disclosure for defendants whose cases are filed on or after January 1, 2025, if the case was entirely dismissed, no appeal is pending, and at least three years have passed since filing or parties stipulated to shielding.

• Shielded records become unavailable for public viewing but remain accessible to court staff, parties involved in the case, and those authorized by Idaho Supreme Court rules.

• Allows any party to petition for sealing of eviction records pursuant to Idaho Supreme Court administrative rules, separate from the automatic shielding process.

• Adds unlawful detainer records shielded under section 6-303A to the list of records exempt from public disclosure under Idaho's public records law (section 74-105).

• Declares an emergency and makes the act effective July 1, 2024.
